Abstract: A study of the laws about sharia banking in Indonesia can be examined completely through the fatwas from the National Sharia Board of the Indonesia Council of Ulama(DSN-MUI).This is important because the suitability of the Sharia practice of Islamic banking based on the fatwa.Fatwas are essentially non-binding but become binding once absorbed into national law.Therefore,when Indonesia discusses and compiles islamic banking laws then the discussion materials refer to the fatwas from the DSN-MUI.The results of research into the Bank Indonesia regulations and Law No.21 2008 about Islamic banking,show that the majority of fatwas were absorbed into Islamic banking laws and regulations.Even the names and legal terms follow the terms used in the fatwas.Only some of the fatwas could not be absorbed into the legislation as they were in opposition to existing banking regulations.
